THE TRUTH OF THE MATTER.

 

“One thing that you should be aware of before you file a complaint, using the Form RC193, Service-Related Complaint. The truth of the matter is that should you decide to file the RC193 Service-Related Complaint Form, the tables will be turned on you as a Canadian taxpayer. If you are owed money from the CRA and have a legitimate refund that is being withheld from you by the CRA, and they are not being forthright in informing you about the reasons for the delay in depositing your tax refund to your bank, you will have another problem.

If the CRA has withheld your refund for a period of 6 months as they have in my case, and they are claiming that your money has not been deposited due to their difficulties in processing your form, The CRA will owe you interest money for the time that they have kept you waiting for your legitimate refund. However, should you file their formal complaint the tables will be turned on you!  You will be forced to accept that you must now pay the CRA now for all of the interest charges during the time that the delay in the processing of your file is taking place.  This can amount to a lot of money that you will owe the CRA that will be deducted from your refund at the time that your deposit will be forthcoming. According to the media reports that I have read from the Auditor General of Canada, it may take the CRA up to four years or longer, in order to act on your formal complaint.

I have another alternative. In my case I have chosen to run my own media campaign, writing articles to address my concerns on the Internet, I call this the “Peoples’ Court,” and the court of, “Public Opinion.” I have sent one letter already to my member of Parliament, The Honorable Andrew Scheer, leader of the Progressive Conservative Party of Canada, there will be other letters forthcoming, that will be addressed to the Minister of National Revenue, the Hon. Diane Lebouthillier.  The issues that I have addressed in my letter to Mr. Scheer have already been voiced by the Opposition Party to the Liberal Party in the House of Commons.

In addition, I have indicated to the CRA representatives that I have spoken to over the telephone, that I will continue to voice my opinions about the withholding of my tax refund in articles that I am writing on the Net, regarding the massive changes in policy that have occurred in the CRA. At least one CRA representative has informed me that my opinion will bear no weight or importance to the CRA when it is addressed through the public venue of the Internet, I have disagreed with that opinion. Kristen, 330542-C  informed me last night that there is no, “power” in complaining outside of the closed complaint avenue through the CRA, I call that statement, “rubbish.”

She also told me to only ask her questions and to not give her any details regarding the reasons for my complaint. I questioned her that if the reasons for my complaint are not valid and I am only encouraged to file a formal service complaint in order to air my concerns; why does the CRA not encourage any preventative measures that would allow for a reasonable resolution to my complaints, without the necessity of a formal complaint procedure being followed? #Makes No Sense AT ALL. CRA would rather spend the taxpayers’ money filing a Form RC193, than attempting to reach a solution with the taxpayer without the necessity of having to spend more of the Canadian taxpayers’ funds by following a formal complaint procedure. #Bad administration and a further wastage of Canadians taxpayers funds. What a shame!

We share your frustration with the performance of the CRA. In the Auditor General’s Fall 2017 Report, he closely examined CRA Calls Centres.  It was found they only answered 36% of incoming calls while blocking 29 million calls from Canadians. More distressingly, 30% of the time, the agency was unable to provide accurate responses to various inquiries. This is completely unacceptable. Canadians deserve accurate and timely answers from the CRA.

HOW TO FILE A “SERVICE COMPLAINT” AGAINST THE CANADA REVENUE AGENCY.

 

“There are many legitimate reasons why a taxpayer may file a service complaint against an employee of the CRA.  The first place to start is the “Taxpayer Bill of Rights” and RC17 “Taxpayer Bill of Rights Guide: Understanding your rights as a taxpayer”.  The next document to consider when completing a service complaint is the CRA’s “Service Standards 2016-2017“. The CRA has also prepared a publication on “Complaints and Disputes”.  You may also wish to consult your accountant, lawyer or bookkeeper to assist you with the drafting of the service complaint.”
